Overview

Hospitals and affiliated entities are participants in one of the most heavily regulated industries in the country: healthcare. Just a few of the major regulatory standards that apply to medical staff include Medicare, Medicaid CoPs, Hospital Licensing Act, Medical Practice Act, Nurse Practice Act, Patient Safety and Quality Improvement Act, HIPAA, Joint Commission, ADA, Title VII, EMTALA; and the list goes on. 

It’s not just a long list but a tall order. The consequences of not complying with the standards are significant, including restriction/ loss of license or accreditation, professional liability claims, loss of Medicare eligibility, False Claims Act liability, loss of job, and civil and criminal penalties among others.

It’s also important to understand that a single set of bylaws cannot ensure compliance with all relevant requirements. Therefore, evidence of compliance needs to be proven by various corporate and medical staff governance documents such as corporate bylaws, medical staff bylaws, as well as accompanying rules, regulations and policies. Governance documents must also include code of conduct, appointment applications, peer review policies, credentialing manual and medical staff development plan among others.

Speaker Profile:

Elizabeth A. ("Libby") Snelson represents medical staffs across the country, focusing on medical staff bylaws, and works for medical societies on medical staff issues.    She handles issues such as "disruptive practitioner" procedures, emergency call coverage and National Practitioner Data Bank reporting, to name only a few. A frequent speaker on medical staff legal issues, Libby presents at medical staff leadership retreats, and in programs sponsored by  medical societies, NAMSS and state medical staff services associations, and other organizations.  Libby is Past President of the American Society of Medical Association Counsel and past Vice President of the ABA Physician Issues Interest Group.  She was a member of the Joint Commission’s MS 01.01.01 Task Force. She is the author of model medical staff bylaws published by state medical socieites, and of The Physicians’ Guide to Medical Staff Organization Bylaws, published by AMA.
